EDITORIAL - Despite What ACLU Says, Schiavo Judge No Civil Libertarian

If Pinellas County Probate Court Judge George W. Greer epitomizes civil liberties, then we're all dead, not just Terri Schiavo.

The Pinellas County chapter of the American Civil Liberties Union has named Greer the 2005 recipient of the Gardner W. Beckett Civil Liberties Award which will be presented to Greer on Thursday, Dec. 8 at the group's Bill of Rights Banquet.

The banquet will be held at the Feather Sound Country Club in Clearwater, one of Michael Schiavo's former employers. How appropo.

The group promotion for the event invites the public to "join us for an evening of celebration in honor of our Constitution, and those who defend it".

"The Pinellas County Chapter of the American Civil Liberties Union confers this honor upon individuals who have demonstrated an outstanding commitment to basic civil liberties, principles, and values inherent in the Bill of Rights. In the footsteps of Gardner Beckett, these recipients exemplify an unflinching commitment to the defense of our constitution and it's guarantees of equal protection, due process, and simple justice", they claim.

Oh, please!

Were it not for the ACLU, Terri Schiavo would probably be alive today.

George Greer wouldn't know the U.S. Constitution, or the Florida Constitution for that matter, if it jumped up and bit him at the banquet. He is the epitome of the increasing number of renegade judges in the United States who habitually ignore the Constitution and state statutes to impose their own political ideologies upon American culture and citizens---also known as judicial tyranny and judicial activism while they hide themselves in their black robes and call it judicial independence.

How much more hypocrisy can there be in Pinellas County? Naming George Greer as Civil Libertarian of the year is an insult the U.S. Constitution and our Bill of Rights.

Greer, 63, is the Pinellas County circuit court judge who caused the death of Terri Schindler-Schiavo, 41, signing an order at the request of her estranged husband and guardian Michael Schiavo to remove her nutrition and hydration. Terri died of starvation and dehydration on March 31, 13 days after her feeding tube had been removed on order of Greer.

George Greer is known around the world as the killing judge, who turned a deaf ear and blind eye to the statutes and the Constitution.

Schiavo had claimed his brain damaged wife was in a persistent vegetative state with no hope of recovery, a diagnosis disputed by numerous prominent neurologists. He also claimed that Terri, who sustained her injuries under suspicious circumstances in 1990, would not want to be kept alive by assisted feeding.

Her parents, Mary and Bob Schindler Sr., battled Schiavo in the courts for nearly 10 years trying to keep their daughter alive and to take her home to care for her.

How does a judge whose appealed decisions get reversed 76% of the time get an award for "all his contributions on the bench" ----as "Civil Libertarian of the Year"?

How can a judge who is overturned by the Second District Court of Appeals of Florida in 21 of the 29 cases in which decisions were issued be cited by the St. Petersburg Bar Association for "grace and professionalism", for following the rule of law and his "judicial independence"----even when he was overturned for improper admittance of hearsay testimony?

Greer was first elected to the bench in 1992 and then reelected in 1998 and 2004 although records obtained from Florida's Division of Elections indicate he didn't legally qualify for office and therefore should not have appeared on the ballot.

Constitutionally, George Greer had no jurisdiction in the Schiavo case because he failed to qualify for office.

Is it constitutional to obstruct justice as George Greer did in the Schiavo case?

Is it constitutional to deny due process rights that were afforded to Terri Schiavo under federal and Florida law?

Is it constitutional to have denied Terri Schiavo her right to counsel and an independent guardian ad litem?

Is it constitutional to defy federal subpoenas?

According to court records, from 1994 until May, 2004, Greer's decisions outside the well-known right-to-life Schiavo case were appealed 32 times. The 2nd DCA dismissed the petitions for appeal without rendering a decision in three of cases but of the 29 cases in which it did render a decision, the lower court decision of George Greer was reversed 22 times.

The appellate court held that Greer failed to hold required hearings, made unconstitutional rulings, acted outside of his jurisdiction, admitted inadmissible hearsay and committed numerous procedural errors.

With a 76% reversal rate and for having made documented unconstitutional rulings, the Pinellas County chapter of the ACLU must have their heads in the sand to call George Greer a civil libertarian. That's one thing he's not.

Greer exhibited a total lack of professionalism, total disdain and disregard for the law in the Schiavo case. Greer's abuse of power, total denial of due process, lack of jurisdiction, judicial incompetence and dishonor of the black robe and gavel have earned him the lifetime achievement award and recognition of judicial tyranny at its worst. He practiced total disdain for society, values and human rights and human life. His total lack of ethics, integrity and compassion cast a disparaging view on the nation's judiciary and made him a poster child for judicial tyranny, personalizing the imminent need in this country today for the reining in of judicial independence and judicial activism".

Greer engaged in an absolute obstruction of due process for Terri Schiavo by his refusal to hold the guardian, Michael Schiavo, accountable for violation of Florida's guardian laws. The guardian spent Terri Schiavo's medical fund on representing his own legal interests, denied her necessary medical services, lives in open adultery with his girlfriend and their two children, petitioned the courts to cremate Terri immediately upon her death and has repeatedly and flagrantly failed to comply with Florida Statutes that mandate the terms of guardianship. Judge Greer couldn't be bothered with those details so long as Terri Schiavo's death was a guaranteed outcome.

Greer impermissibly applied post-1990 substantive law to Terri's pre-1990 oral declaration regarding end of life issues and acted beyond his judicial powers, violating the separation of powers doctrine by making the health care decision to end a disabled woman's life. That's not protecting civil liberties and he shouldn't receive any awards for causing the death of an innocent woman.

There are more than sufficient grounds to impeach George Greer and that should be the upmost priority of the Florida House when it convenes next week.

Greer set the stage for the mass killing of the disabled and elderly in the United States as part of the government's effort to save on Medicare, Medicaid and Social Security costs. Greer firmly established the Culture of Death in the United States. No one should be rewarded for that.

Greer singlehandedly did more to damage the public's trust and faith in the judicial system that virtually any other person in the United States. He made a complete mockery of the system with his handling of the Schiavo case, controlling the case for over seven years and using the bench and black robe to sanction judicial homicide, ordering a disabled woman to die a grueling, agonizing death by starvation and dehydration---a cruel, unusual and inhumane judgment by anyone's standards---except maybe George Felos, attorney for the husband who lobbied Greer for over seven years for the death warrant.

George Felos-----a merchant of death whose fees were paid from Terri Schiavo's money that was earmarked by a judge and jury to rehabilitate Terri---not to kill her----and by the American Civil Liberties Union.

In October, 2003, the ACLU of Florida today joined with Michael Schiavo challenging Terri's Law, which reversed a series of Greer's rulings and saved Terri's life. The ACLU said the actions of Florida lawmakers and Governor Jeb Bush to undo decisions by the courts and order the reinsertion of her feeding tubes were violations of Florida's constitutional right to privacy and an unconstitutional intrusion on judicial authority.

Greer never had judicial authority in the case because he never had jurisdiction. He violated and disrespected the U.S. Constitution.

Considering that George Greer was bought and paid for by the ACLU, no wonder they're claiming he's a civil libertarian.

There is clear and convincing evidence that George Greer single-handedly did more to dishonor the judiciary of the U.S. than any other judge in the history of the U.S., engaging in a horrific abuse of judicial power, arrogantly thumbing his nose at the Governor, the President, Congress, the Florida Department of Law Enforcement and even the Vatican while totally abandoning any trace of ethics.

No elderly person or handicapped person in America is safe today because of George Greer and the band of attorneys such as those in the Schiavo case who were funded by the ACLU, who have their tentacles attached to the estates and assets of these vulnerable people through guardianship. George Greer has done more to advance the Culture of Death in America today than any one else this decade and for that, he should be properly recognized----but not by given any more phony awards.

In the blurb written on Greer by ACLU member Nano Riley, she says that Greer "truly believes in the rule of law". He got a BS degree from the Florida State University, that's for sure.

The Traditional Values Coalition has opined that there are two basic principles of law known as "original intent" and the "rule of law". Judges are to rule on laws based on the original intent of the legislature who created the laws, not their own personal opinions or political agendas----or those of these legal cronies as those in the Schiavo case who supported the euthanasia-death culture agenda of George Felos, Project Grace, George Soros and the Hospice of Florida Suncoast, the organization of which Felos served as chairman and member of the board of directors in addition to other principals in the Schiavo case.

Judges are also to respect the "rule of law" meaning, as the Coalition states, that they are to make impartial judgments upon laws passed by local, state or federal legislatures when these cases involve constitutional issues.

George Greer didn't make one impartial statement in his seven-year dictatorship of the Schiavo case. There was absolutely no appearance of impartiality. Bias and prejudice towards the handicapped woman and her family prevailed in Greer's court Despite his biased rulings, documented conflicts of interest and improper associations and prohibited discussions of the case, Greer steadfastly refused to recuse himself from the case as is ethically required. He pushed ethics to the wall with his violations of campaign law and unlawfully using the offices of the Pinellas County public defender and Bob Dillinger; the sheriff's office of his his long-time buddy Everett Rice and Bernie McCabe, state attorney, to promote his reelection campaign---paid for by Pinellas County taxpayers while he shrouded himself in the black robe-a black robe he had no authority to wear and should be stripped from him.

Time and time again Greer disregarded the U.S. Constitution, Florida Statutes and ultimately, even defied a federal Congressional subpoena and the Establishment Clause of the U.S. Constitution, to engage in a blatant, arrogant and abusive judicial usurptation.

Greer routinely ignored both principles of original intent and rule of law and created laws to fit his own political and social agenda, engaging in judicial activism and legislating from the bench, making up the law as he went.

The rule of law in the Schiavo case and as it is applicable to George W. Greer, demands and dictates that he be disbarred and removed from the judicial office that he has never legally held. He has engaged in an abhorrent, reprehensible raw display of judicial tyranny. Removing George Greer from the bench would be a true expression of civil liberty.
